Spurs recently lodged an official complaint demanding that United be held accountable for the suspicious manner in which they declared their interest in Berbatov, who is now eager to leave White Hart Lane.
The North London club insist that the European champions circumvented a number of Premier League regulations in making contact with the Bulgarian international's representatives, chief among which are the laws preventing clubs from publicly announcing their intention to sign a player and those which forbid approaches for players without the owning club's permission.
Sir Alex Ferguson has already laughed off the Lilywhites' objections, as much of their evidence stems from dubious quotes in a newspaper article that the United manager has denied uttering.
And the PL's judiciary panel - comprising Richard Scudamore, Mike Foster and Sir Dave Richards - have sided with the Red Devils for the time being, calling for both clubs to provide more substantial evidence to back up their respective claims.
Tottenham also planned to press charges against Liverpool regarding their move for Robbie Keane, but they withdrew the complaint following the completion of the Irishman's transfer to Anfield.
Such an avenue remains open for the Berbatov case, as recent reports suggest United and Spurs are close to reaching an agreement that will see the 27-year-old move to Old Trafford in a deal worth around £28million.
